All parents of a child have a right to visitation with their child. On a rare occasion, the court will reduce, suspend, or even reserve this right if there are substantial problems with a parent such as serious alcohol/drug abuse, physical or sexual abuse, etc. Otherwise, both parents can expect to have residential time with the child or children. The amount of residential time is the next question. The court will sometimes will follow a 50/50 parenting plan, but in most instances will place the children with one parent primarily. The decision of which parent to place the child with is dependant on a variety of factors, including the strength of the relationship with the parties, their historical time with the children and their ability to spend time with the children going forward.
